1. Acceptance of Terms

By accessing or using the VikiViki mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the App. These Terms constitute a legally binding agreement between you and GACMeta TECHNOLOGY., LIMITED ("we," "us," or "our").

2. Description of Service

VikiViki is an AI character roleplay chat application that allows users to engage in conversations with AI-powered characters. The App provides a platform for creative, interactive storytelling and roleplay experiences through AI-generated responses. The quality, accuracy, and nature of AI responses may vary and are subject to the capabilities of the underlying AI technology.

3. User Accounts

3.1 Registration

To use certain features of the App, you must create an account. You may register using your email address, Google account, or Apple ID. You agree to provide accurate, current, and complete information during registration.

3.2 Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 Age Requirement

You must be at least 13 years of age to create an account and use VikiViki. If you are under 18, you represent that you have your parent or legal guardian's permission to use the App. We reserve the right to terminate accounts of users who are found to be under the minimum age requirement.

4. User Content & Conduct

4.1 User Content

You retain ownership of the content you create within the App, including chat messages you send to AI characters. By using the App, you grant us a limited license to process your content as necessary to provide the service.

4.2 Prohibited Conduct

When using VikiViki, you agree not to:

  • Use the App for any illegal purpose or in violation of any applicable laws or regulations
  • Attempt to exploit, harm, or engage in inappropriate interactions involving minors
  • Generate or distribute content that promotes violence, harassment, hate speech, or discrimination
  • Attempt to reverse-engineer, decompile, or extract the source code of the App or its AI systems
  • Use automated systems, bots, or scripts to access the App or circumvent usage limits
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity
  • Share your account credentials with others or allow others to access your account
  • Interfere with or disrupt the App's infrastructure or other users' experience

5. AI-Generated Content Disclaimer

AI responses are entirely fictional and generated by artificial intelligence. You acknowledge and agree that:

  • AI character responses are computer-generated and do not represent the views or opinions of GACMeta TECHNOLOGY., LIMITED or any real person
  • AI-generated content should not be considered as professional advice of any kind, including but not limited to medical, legal, financial, or psychological advice
  • AI responses may contain inaccuracies, errors, or inappropriate content despite our efforts to implement safety measures
  • You should not rely on AI-generated content for making important decisions
  • We are not liable for any actions taken based on AI-generated content

6. Intellectual Property

6.1 Our Intellectual Property

The App, including its design, features, code, AI characters, character designs, logos, and all related intellectual property, is owned by GACMeta TECHNOLOGY., LIMITED and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our intellectual property without our prior written consent.

6.2 User Content License

By submitting content to the App, you grant GACMeta TECHNOLOGY., LIMITED a non-exclusive, worldwide, royalty-free license to use, process, and store your content solely for the purpose of providing and improving the service.

7. Subscriptions & Payments

7.1 Subscription Plans

VikiViki offers subscription plans that provide access to premium features. Subscriptions are purchased and managed through Apple App Store or Google Play Store in-app purchases.

7.2 Auto-Renewal Terms (Apple)

Payment will be charged to your Apple ID account at the confirmation of purchase. The subscription automatically renews unless it is canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase. Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.

7.3 Auto-Renewal Terms (Google)

Payment will be charged to your Google Play account at the confirmation of purchase. The subscription automatically renews unless it is canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel your subscriptions in your Google Play Store account settings. Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.

7.4 Price Changes

We reserve the right to change subscription pricing. Any price changes will take effect at the start of the next subscription period following the date of the price change. Your continued use of the App after the price change constitutes your agreement to pay the updated price.

8. Refunds

All purchases are processed through Apple App Store or Google Play Store. Refund requests are handled by Apple or Google in accordance with their respective refund policies. We do not directly process refunds. To request a refund:

  • Apple: Visit reportaproblem.apple.com or contact Apple Support.
  • Google: Visit the Google Play Store and follow their refund process, or contact Google Play Support.

9. Termination

We reserve the right to suspend or terminate your account and access to the App at our sole discretion, without prior notice or liability, for any reason, including but not limited to:

  • Violation of these Terms
  • Engaging in prohibited conduct
  • Fraudulent or illegal activity
  • Extended periods of inactivity
  • At your request

Upon termination, your right to use the App will immediately cease. We may delete your account data in accordance with our Privacy Policy.

10. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GACMeta TECHNOLOGY., LIMITED, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of HONG KONG, without regard to its conflict of law provisions. Any disputes arising from these Terms or the use of the App shall first be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the competent courts of HONG KONG.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Your continued use of the App after any changes to these Terms constitutes acceptance of those changes.
